  2. USERS Access to and/or use of this BMS website attributes the status of USER, who, by virtue of such access and/or use, accepts the General Terms of Use set out herein. The aforementioned Terms shall apply regardless of any General Terms of Contract that may be mandatorily applicable.

USE OF THE PORTAL The USER undertakes to make appropriate use of the contents and services (such as chat services, discussion forums or news groups) that BMS offers through its website and, by way of example but not limitation, not to use them to (i) engage in unlawful, illegal activities or those contrary to good faith and public order; (ii) disseminate content or propaganda of a racist, xenophobic, illegal-pornographic nature, advocating terrorism or attacking human rights; (iii) cause damage to the physical and logical systems of BMS, its suppliers or third parties, introduce or disseminate computer viruses on the network or any other physical or logical systems liable to cause the aforementioned damage; (iv) attempt to access and, where appropriate, use the email accounts of other users and modify or manipulate their messages.

    BMS reserves the right to remove any comments and contributions that infringe respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that harm youth or childhood, public order or security, or that, in its opinion, are not suitable for publication. In any event, BMS shall not be liable for the opinions expressed by users through forums, chats, or other participation tools.

    2. PURPOSE OF PROCESSING THE DATA AND CATEGORIES OF DATA PROCESSED

      The collection and automated processing of personal data is intended to provide and offer our services and to inform about improvements to the website. The personal data collected through the forms on our Website will be incorporated into BMS's files for the maintenance of the commercial relationship and the performance of information tasks and other activities of BMS.

      For what purpose? The collection and automated processing of personal data is intended for the maintenance of the commercial relationship and the performance of information, training and other activities of BMS.

      How long does BMS keep your data? BMS may retain your data, once all relations with the user have ended, in order to comply with legal obligations. Likewise, it shall proceed to delete the data collected when they are no longer necessary for the purposes for which they were obtained.

      What is the legal basis for processing your data? The processing of users' data is carried out on the basis of the freely given, specific, informed and unambiguous consent provided by them, since they are informed by being made aware of this privacy policy. INTELLECTUAL AND INDUSTRIAL PROPERTY: BMS, on its own account or as assignee, owns all the intellectual and industrial property rights of its website, as well as the elements contained therein (including, by way of example, images, sound, audio, video, software or text; trademarks or logos, colour combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), owned by BMS or by its licensors. By virtue of the provisions of Articles 8 and 32.1, second paragraph, of the Spanish Intellectual Property Act, the reproduction, distribution and public communication, including making available, of all or part of the contents of this website, for commercial purposes, on any medium and by any technical means, without the authorisation of BMS, is expressly prohibited. The USER must refrain from removing, altering, evading or manipulating any protection device or security system that may be installed on the BMS website.

MODIFICATIONS BMS reserves the right to make, without prior notice, such modifications as it deems appropriate to its website, and may change, delete or add both the contents and services provided through it as well as the manner in which they are presented or located on its servers. This shall not affect any agreements that may have been entered into previously.
  7. LINKS In the event that the website provides links or hyperlinks to other Internet sites, BMS shall not exercise any kind of control over such sites and contents. Under no circumstances shall BMS assume any liability for the contents of any link belonging to a third-party website, nor shall it guarantee the technical availability, quality, reliability, accuracy, breadth, truthfulness, validity and constitutionality of any material or information contained in any of these hyperlinks or other Internet sites. Likewise, the inclusion of these external connections shall not imply any kind of association, merger or participation with the connected entities.
  8. RIGHT OF EXCLUSION BMS reserves the right to deny or withdraw access to the website and/or to the services offered without prior notice, on its own initiative or at the request of a third party, to those users who breach these General Terms of Use.
  9. GENERAL PROVISIONS BMS shall pursue the breach of these terms as well as any improper use of its website by exercising all civil and criminal actions to which it may be entitled under the law.
